1. General

These General Terms and Conditions apply to all contracts, deliveries, and services provided by Alpha Cores (Alpha Beta Gamma Ltd). Any conflicting terms and conditions from the customer are expressly excluded. Any additional agreements or changes to these terms must be confirmed in writing to be effective.

Alpha Cores (Alpha Beta Gamma Ltd) reserves the right to update or modify these General Terms and Conditions, including any related documents, by providing reasonable notice. Orders placed before any such changes will be subject to the previous version of these Terms and Conditions.

Minor variations and technical adjustments in product images or descriptions are possible.

2. Conclusion of a Contract

When you place an order on the Alphacores website (www.AlphaCores.co.uk), this constitutes an offer to Alpha Cores to enter into a purchase contract. After you place an order, we will send you an email confirming receipt of your order and detailing its contents. This order confirmation does not signify acceptance of your offer; it merely confirms that we have received it. A purchase contract is only formed when we dispatch your order and send you a dispatch confirmation or when the products are delivered to you.

3. Shipment, Delivery, and Payment

Delivery will be made from our warehouse to the delivery address you provide. Specific delivery and payment options will be detailed in the product description. We do not have a minimum order value. Alpha Cores reserves the right to limit order quantities to reasonable commercial amounts.

We may make partial deliveries if this helps to process your order quickly and is reasonable for you. You will not incur any additional shipping costs for partial deliveries. If you request a special shipping method, you will be charged the standard additional fees for that service.

Payment is due immediately upon placing a binding order. Unless otherwise agreed, payment must be made exclusively by prepayment, credit/debit card, or bank transfer.

4. Delivery Times

Goods that are in stock will typically be dispatched within 1 to 2 working days after we receive payment. If an item is not in stock when you order, we will aim to deliver it as soon as possible.

If a delivery or service deadline is delayed due to circumstances beyond our reasonable control, such as acts of God, industrial disputes, unforeseen complications, or other events we are not at fault for, the deadline will be extended accordingly.

If a delivery deadline is missed for reasons other than those mentioned above, you may set a reasonable new deadline and notify us that if this new deadline is not met, you can cancel the affected part of the contract. If the new deadline is not met, you may then cancel the delivery or service specified in the contract.

If delivery is impossible due to the unavailability of the manufacturer or our suppliers, and the agreed delivery date has been exceeded by more than 2 months, both we and you may cancel the contract for the affected items.

To the extent permitted by law, claims for damages due to delay, inability to deliver, or failure to fulfill obligations, even those arising from withdrawal of the contract, are excluded unless a legal representative of Alpha Cores has acted deliberately or with gross negligence.

5. Guarantees and After-Sales Service

We warrant that the goods will substantially conform to their stated description and specifications.

We also warrant that the goods will be of satisfactory quality at the time of delivery by our carrier.

We offer a voluntary returns policy for goods that do not meet your expectations, as outlined below.

Subject to you complying with our voluntary returns policy, we guarantee that the goods will remain of satisfactory quality under normal use for 3 months from the date of delivery. If the goods do not meet this standard within this period and are returned according to our policy, we will offer a refund, credit, or replacement. The specific timescales for returns under this voluntary code are detailed in the "VOLUNTARY CODE FOR THE RETURN OF GOODS BY YOU TO US" section below.

The terms of any manufacturer's guarantee and after-sales service will be included in the documentation provided with the goods.

We may offer advice to you under the conditions outlined below.

Upon receiving the goods, you must inspect them immediately for any obvious defects or issues with quality. Any apparent defects must be reported to us in writing within 5 days of discovery. The same applies to any hidden (latent) defects, which must be reported in writing within 5 days of their discovery. Failure to report defects within these timeframes may affect your warranty rights. Our standard warranty period is 12 months from the date of shipment.

For any warranty claims, you must provide proof of purchase (e.g., a receipt). The item in question, along with all original accessories and a detailed description of the fault, must be returned in its original packaging (with suitable outer packaging and sufficient postage paid), accompanied by a copy of the delivery receipt.

The warranty does not cover normal wear and tear or damage resulting from misuse. The warranty will be void if the customer modifies the delivered goods. For defects caused by improper handling by the buyer, the buyer will be responsible for all costs associated with repair and transport. Alpha Cores has the right to repair defective goods free of charge during the warranty period.

6. Your Responsibilities

It is your responsibility to ensure that any goods you order from us are compatible with your existing system components and any other goods you may purchase from us.

It is your responsibility to ensure the correct installation of our goods into your system.

It is your responsibility to visit the manufacturer's website to download any necessary product updates, including drivers and manuals, where applicable.

7. VOLUNTARY CODE FOR THE RETURN OF GOODS BY YOU TO US (Consumer Customers Only)

This voluntary code applies only if you are a consumer. It is intended to foster positive relations and does not affect your statutory rights.

IMPORTANT: In some cases, the terms of this voluntary code may be more or less favorable than your statutory rights. You are free to choose to rely on your statutory rights at any time. If you have any doubts about your statutory rights, you may wish to seek legal advice from a solicitor or a consumer advice organization.

THE CODE:

We understand that goods supplied by us may sometimes not meet your expectations for various reasons, such as manufacturing defects, incompatibility, incorrect installation, or performance that doesn't meet your requirements.

To understand why goods have not met your expectations, we require the opportunity to inspect and test them.

If goods fail to meet your expectations, please return them to us with a clear explanation of the issue.

If we agree that the problem arose due to a defect present in the goods at the time of delivery:

  • We will refund the cost of the goods if returned within 28 days of the delivery date.
  • In other cases (after 28 days), we will offer to replace the goods or provide you with a credit for the cost of the goods.

When you return goods claiming a defect at the time of delivery, we will inspect and test them.

If our inspection reveals that there was no defect in the goods at the time of delivery, we reserve the right to charge you a reasonable fee (currently £19.99) to contribute towards the cost of inspection and testing.

Even if we determine that there was no defect at the time of delivery:

  • We will still try to assist you in resolving the problem.
  • Depending on the age and condition of the goods, we may offer to accept the return subject to a restocking charge and refund or credit the remaining cost.
  • If the age or condition of the goods prevents us from accepting the return, we will redeliver the goods to you, and you agree to pay the reasonable cost of redelivery.

8. Right of Withdrawal (Consumer Customers Only)

As a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period will expire 14 days after the day you (or a third party nominated by you, other than the carrier) take possession of the goods.

To exercise your right of withdrawal, you must inform us (Alpha Beta Gamma Ltd, Unit 4 Landerry Industrial Estate, School Lane, Selsey, West Sussex, PO20 9ER, or by email to [Your Customer Service Email Address]) of your decision to withdraw from this contract by a clear statement (e.g., a letter sent by post or email). You may use the model withdrawal form (available on our website), but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exceptions to the Right of Withdrawal:

The right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalized.

9. Passing of Risk

The risk of loss or damage to the goods passes to you upon our delivery of the goods to the carrier. For returned goods, the risk, including transport risk and costs, remains with the sender until the goods are received by Alpha Cores.

10. Reservation of Title

Alpha Cores retains ownership of all delivered goods until full payment of all outstanding amounts related to the business relationship has been received from the buyer, regardless of the nature or legal basis of these amounts.

11. Storage of Data

In accordance with the Data Protection Act 2018 and GDPR, we inform you that the data necessary for processing your order will be electronically stored and processed. All personal information will be treated confidentially. By placing an order, you explicitly consent to the collection, processing, and use of your personal data for the purpose of fulfilling the contract.

You have the right to access, rectify, erase, restrict processing, object to processing, and data portability of your stored data at any time, free of charge. Please contact us if you wish to exercise these rights.

We will not share your personal data, including your address and email address, with third parties without your explicit consent, which you can revoke at any time.

This excludes our service partners who require the data to process your order (e.g., the shipping company and payment processor). In these cases, the scope of the transmitted data is limited to the necessary minimum.

12. Concession of Rights, Customer Assessments

If a user submits a product review on the Alphacores website, the user grants Alpha Cores a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. Alpha Cores reserves the right not to publish a review or to publish it for a limited time, as well as to shorten or modify it. Customer reviews reflect the opinions of individual customers and do not necessarily represent the views of Alpha Cores.

13. Place of Execution and Legal Venue

For commercial customers, the place of execution and exclusive legal venue for all disputes arising from or related to these terms and conditions or the contract is the location of Alpha Cores. For private customers residing within the United Kingdom, the place of execution and legal venue is their place of residence, subject to applicable law. If the customer resides outside the United Kingdom, the exclusive legal venue is the location of Alpha Cores, and the laws of England and Wales shall apply.

14. Limitation of Liability

To the maximum extent permitted by law, Alpha Cores shall not be liable for any indirect, incidental, or consequential damages.

15. Severability Clause

If any provision of these terms and conditions is found to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intention.
